Homeowners Associations are intended to make sure that homes maintain a certain standard to protect the values of all the homes is the neighborhood. But if you are subject to one, you’ve probably been frustrated at one time or another. Homeowners Associations seem to want to keep the status quo. From color schemes to screen doors to room additions, they want to keep the neighborhood looking nice. Unfortunately, nice often means plain. Anything that’s different is controversial, so they try to avoid that.
Enter a good change: solar energy systems. On the surface, it sounds like a good thing if a homeowner invests in a solar energy system. It makes that home more valuable and reflects well on the neighborhood as a whole.
Homeowners associations hate them. Some people will argue that they’re unsightly, but I don’t think that’s it. I suppose if you look at houses in general, you’ll find some features that are more attractive than others. Trees, bay windows and stone walkways are attractive. Garage doors, antennas and driveways usually aren’t, but they’re part of typical houses and neighborhoods. We’ve become accustomed to them. Not so with solar panels, but that’s just because they’re new. If solar panels had been around for 50 years, we would consider them a normal part of a house.
So what if you want to install a solar system on your roof and your homeowners association says no? They have the right to approve or disapprove permanent additions to your house. Fortunately if you live in California, the state legislature solved the problem for you. In 2008 they passed Assembly Bill 1892, which severely limits homeowners associations’ ability to deny approvals for solar systems. So long as the solar energy system meets safety standards, the homeowners association must approve it. They cannot require you to do something that would cost more than an additional $2,000, like install the solar roof shingles.
Many homeowners associations are either unaware of the new law, or are choosing to disregard it. Don’t worry, though. The law also requires that if you sue them and win, they will have to pay your reasonable legal expenses plus up to $1,000. If you make them aware of this, hopefully you won’t have to go to the trouble of filing a lawsuit at all.
So go ahead and start checking out solar panels prices, regardless of what your homeowners association says. Get the approval process started, because it might take a little longer if your HOA needs to be convinced. Solar energy is more popular now that it’s ever been and there are a lot of places to find solar panels for sale.
